The King’s Fund response to proposals for reform of the Mental Health Act

Our submission to the open consultation on the government’s proposals for reform of the Mental Health Act (MHA) responded to the question: ‘How could the Care Quality Commission (CQC) support quality and safety of care by extending its monitoring powers?’

Our response highlights that extending the powers of CQC to look at information from a range of sources in order to identify where there could be concerns with service provision is positive step. However, the ability of CQC to carry out its role in monitoring the MHA is fundamentally undermined by the quality of data available on use of the MHA. The lack of robust data will also undermine any future efforts to evaluate the impact of reforms to the MHA on rates of detention.
